OKLAHOMA CITY — The U.S. Department of Justice (DOJ) sent a letter to Oklahoma Gov. Kevin Stitt and Attorney General Gentner Drummond threatening to sue the state unless it does not enact House Bill 4156, Oklahoma’s latest anti-immigration bill.
The bill will make “impermissible occupation”, or entering the state without legal authorization to be in the United States, a crime.
Drummond responded on May 17 to the DOJ, calling the letter “disingenuous” and stating that if the Biden administration sues he will “vigorously defend Oklahoma and its people.”
DOJ Asserts House Bill 4156 Violates Federal Law and Constitution, Threatens Legal Action
The DOJ’s letter, sent to Stitt and Drummond on May 15, said House Bill 4156 is preempted by federal law and violates the United States Constitution. Unless Oklahoma agrees to refrain from enforcing the bill, the DOJ will sue.
The state had until today to agree to remove the new law that will take effect July 1, 2024.
The first offense is a misdemeanor punishable by one year in county jail and a fine of up to $500 or both. The person would be required to leave the state within 72 hours.
A second offense is a felony with up to two years in prison, a fine of up to $1,000 or both.
“The United States is committed to the processing of noncitizens consistent with the Immigration and Nationality Act (INA),” the letter reads. “House Bill 4156 is contrary to that goal.”
The DOJ’s letter said the bill interferes with the federal government’s ability to enforce the entry and reentry provisions of the INA. The letter notes the bill “improperly regulates” the international movement of persons in violation of the Foreign Commerce Clause and undermines the United States’ foreign relations.
Drummond said the letter falsely asserts the Biden administration is committed to enacting the INA. He said it has been “glaring” that “the Biden administration is only committed to subverting the immigration laws of this county.”
“My office — and the millions of law-abiding Oklahomans whom it is my privilege to serve — will not accept lectures or threats about immigration from this failed administration. To do otherwise in this instance would ignore the fundamental safety of our citizens and the integrity of our borders, and it would represent an inexcusable dereliction of my own duty as Oklahoma’s chief law officer.”
Drummond said in his letter to the DOJ.
The Co-Author of Legislation Responds
Oklahoma House Speaker Charles McCall, co-author of the bill, responded to the DOJ’s letter today, stating, “the Biden Administration’s continued failures to address the illegal immigration crisis in our country are what necessitated the passage of House Bill 4156 in the first place.”
“I find it laughable that the administration’s letter to Gov. Stitt and Attorney General Drummond, they claim Oklahoma is interfering with the function of the federal government of immigration issues,” McCall said in a statement Monday. “There has been nothing but dysfunction at the federal level since President Biden took office.”


What the DOJ is trying to say is they what NON-Citizens that are here ILLEGALLY to have US Constitutional rights. Which they DO NOT have because the US Constitution was written for US CITIZENS so the ONLY Rights the ILLEGALS actually have is the rights from their own countries NOT US Rights which they all need to return to so they can enforce their rights there. Anything else would mean there is no US Constitution or US Citizenship and America as a Country doesn’t exist.
